Can my friend sue her tanning salon for getting a staph infection from one of their beds?

My friend got a staph infection and strongly believes the only place she could've gotten it was her tanning salon. Can she sue? Also, how does the court system prove weather or not she got the infection from the salon? What if she got the infection on a day her particular bed was infected by someone else and then not sterilized properly, but later that night when they closed shop maybe they cleaned the bed properly at that time and removed the evidence of the staph having originated from the bed? She could, but there is going to be a huge investigation into exactly how she got the staph infection. If there is anything else she could've done to get a staph infection, it won't go far.Can my friend sue her tanning salon for getting a staph infection from one of their beds?
The court doesn't have to prove it. You friend does. She can contact an attorney and try to sue them, but proving it can be difficult. Then again, to avoid bad publicity, the salon may just offer a settlement.. like paying her medical bills. proof could be hard to come by.
You can sue anybody for anything. Doesn't mean you have recourse to sue them, but you can.





Also, it is not the courts duty to prove ';whether'; or not she got it from the salon'; it is HER burden of proof.
She can sue, but she won't win. She has no evidence. She has to prove it. The burden of proof falls on her shoulders.
yeahhh . in this day and time you can sue for picking your nose in public.
Lol no..... No evidence you have nothing. A lawyer would laugh at you. And there is no way in hell she would really know if it was from that!

Hmm. Depends on what kind of staphylococcus she has. And where it is... On the back of the legs/arms/torso?? Maybe so? If on the face or some other frontal part of the body, maybe not... Did she ever go to the dr. and get a Culture/Sensitivity. People carry around all sorts of germs on their skin, in their mouth, etc, (including staphylococcus). This bug is an opportunistic one, meaning that it could only cause illness in someone who didn't have a healthy immune system. Wounds are also places where this could occur... is the infection more of a skin rash, or located in a wound? Ingrown hairs can also cause staph infections too... carbuncles/furuncles...check into those as well...





Staph toxins are also a common cause of food poisoning, so I'd ask her if she might have any stomach issues associated with a food poisoning. The only real staph to worry about is MRSA - which is a resistant to the drug, methicillin. MRSA can be community-acquired though...





Tough call to make, about suing... I'm not a lawyer, but I'd assume you'd have to be able to prove that the facility isn't properly maintaining the cleanliness of the tanning beds and get ';evidence';... If you know anyone else that goes to this tanning place, you could always ask them if they've experienced any rashes/infections too... Best bet is to maybe wipe down the beds before you get in, if possible... And definitely tell the Tanning bed people your problem...I think unless a lot of people get infections and they involved the Health Dept, I think you'd be hard pressed to sue...
